1. General

These Terms & Conditions apply to all sales made by Blue Marine Systems LTD (“we”, “us”, “our”) via our website.

By placing an order, you agree to be bound by these Terms & Conditions.

We reserve the right to update these Terms at any time. The version in force at the time of purchase will apply.

2. Products

Our products are marine air-conditioning systems and associated components designed for installation in marine environments.

All technical specifications, performance data and compatibility information are provided in good faith but must be independently verified by the installer prior to installation.

Marine air-conditioning systems must be installed and commissioned by a suitably qualified marine HVAC engineer.

Improper installation may result in equipment failure and void warranty protection.

3. Pricing & Payment

All prices are listed in GBP (£).

VAT is included where applicable.

We reserve the right to amend pricing without notice.

Payment must be received in full before dispatch.

International customers are responsible for all local import duties, taxes and customs charges.

We reserve the right to refuse or cancel any order at our discretion.

4. Shipping & Delivery

We ship from the United Kingdom.

Delivery timeframes are estimates only and not guaranteed.

Risk passes to the customer upon delivery.

Customers must inspect goods immediately upon receipt.

Any transit damage must be reported in writing within 48 hours of delivery.

Failure to report damage within this timeframe may invalidate claims.

Shipping costs are calculated at checkout.

5. Installation & Refrigerant

Units are supplied factory-evacuated unless otherwise specified.

The correct refrigerant type and charge weight are clearly displayed on the unit nameplate/control box.

It is the responsibility of the installing engineer to:

Verify refrigerant type

Pressure test the system

Perform correct vacuum evacuation

Charge the unit with the specified refrigerant

Charge to the exact manufacturer-stated weight

Incorrect refrigerant type, incorrect charge weight, improper vacuuming, or failure to pressure test correctly will void the warranty.

6. Warranty

Blue Marine Systems LTD provides a 1-Year Parts-Only Limited Warranty from the date of purchase for all customers worldwide.

This warranty covers manufacturing defects in materials and workmanship under normal marine use.

What Is Covered

Defective components due to manufacturing fault

Replacement parts supplied at our discretion

What Is Not Covered

This warranty does NOT cover:

Labour costs

Installation costs

Removal or refitting

Haul-out costs

Travel time

Refrigerant or re-gassing

Incorrect refrigerant charging

Incorrect installation or commissioning

Pressure testing or vacuuming failures

Electrical supply faults

Power surges or low voltage

Blocked or restricted seawater systems

Corrosion, electrolysis, or galvanic damage

Freeze damage

Environmental exposure damage

Charter or commercial income loss

Vessel downtime

Consequential or indirect losses

Installation Requirements

All units must be installed and commissioned by a qualified marine HVAC engineer.

Failure to:

Pressure test correctly

Vacuum correctly

Charge with the correct refrigerant type

Charge to the specified weight shown on the unit will void this warranty.

Claims Procedure

All warranty claims must include:

Proof of purchase

Installation details

Clear description of the fault

Supporting photographs or video evidence

We reserve the right to inspect, test, or request return of the defective component before approving any claim.

Our sole liability under this warranty is limited to the supply of replacement parts only.

7. Returns

Returns must be authorised in writing prior to sending goods back.

Custom or special-order products are non-returnable.

Returned items must be unused and in original packaging.

Restocking fees may apply.

8. Limitation of Liability

To the fullest extent permitted by law:

Blue Marine Systems LTD shall not be liable for:

Indirect or consequential losses

Loss of charter income

Vessel downtime

Loss of profit

Installation costs

Environmental damage

Damage resulting from incorrect installation

Our total liability shall not exceed the purchase price paid for the goods supplied.

Nothing in these Terms excludes liability for death or personal injury caused by negligence where required by law.

9. Commercial Use

Our products may be installed on private or commercial vessels.

Commercial operators are responsible for ensuring compliance with all applicable local regulations and certification requirements.

10. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
