1. Introduction
These Terms & Conditions apply to all sales of products by Blue Marine Systems Ltd (“we”, “us”, “our”) via our website and direct sales channels. By placing an order with us, you agree to be legally bound by these Terms & Conditions.
2. Products
Our products include marine air conditioning systems and related components intended for professional marine installation. All product descriptions, technical specifications and images are provided in good faith. Minor variations in specification or appearance may occur without notice as part of continuous product improvement. It is the customer’s responsibility to ensure the selected product is suitable for their vessel and intended application.
3. Orders & Payment
All orders are subject to acceptance and availability. Full payment must be received prior to dispatch. We reserve the right to cancel or refuse any order at our discretion. Prices are displayed in GBP (£) unless otherwise stated. Where regional storefront pricing is used, pricing may differ between regions. Orders placed for delivery outside the intended pricing region may be cancelled.
4. Shipping & Delivery
All products are shipped from the United Kingdom. Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by courier services, customs clearance procedures, weather conditions, supply chain disruption or events beyond our reasonable control. Risk in the goods transfers to the customer upon delivery. International customers are responsible for all applicable import duties, VAT, taxes and customs clearance fees in the destination country.
Certain units may be shipped pre-evacuated to zero pressure and require correct refrigerant charging prior to commissioning. Refrigerant charging must be performed by a qualified technician in accordance with the specification indicated on the unit.
5. Installation Requirement
All marine air conditioning systems must be installed and commissioned by a qualified marine HVAC professional. Improper installation, incorrect refrigerant charging, inadequate seawater flow, insufficient electrical supply or installation in a non-marine environment may cause permanent damage and will invalidate the warranty.
6. Returns & Cancellation (UK Consumers Only)
If you are a UK consumer purchasing online, you have the right to cancel your order within 14 days of delivery under the Consumer Contracts Regulations 2013. The product must be unused, uninstalled, and returned in its original packaging. The customer is responsible for return shipping costs. We reserve the right to make deductions for any reduction in value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods. Custom-built, special-order, and business-to-business sales are non-refundable.
7. Warranty
For purchases delivered within the United Kingdom, we provide a two-year parts-only limited warranty from the date of delivery. For purchases delivered outside the United Kingdom, we provide a one-year parts-only limited warranty from the date of delivery.
The warranty covers manufacturing defects in materials and workmanship, including compressor failure due to internal defect and electrical control board failure caused by manufacturing fault. The warranty does not cover installation errors, incorrect refrigerant charging, improper voltage supply, lack of maintenance, seawater corrosion due to inadequate servicing, blocked seawater circuits, damage caused by failure to winterise, labour costs, travel costs, removal or reinstallation expenses, refrigerant costs, cosmetic damage or normal wear and tear.
All warranty claims require proof of purchase, confirmation of professional installation and a detailed description of the fault supported by images or video evidence where reasonably requested. We reserve the right to request the return of defective components for inspection before authorising replacement. Warranty replacements cover parts only and do not include labour or associated costs.
8. Technical Responsibility
The customer is responsible for verifying refrigerant type and charge weight as specified on the unit, ensuring correct breaker sizing and electrical protection, providing adequate and uninterrupted seawater flow, and following the installation manual available via the QR code affixed to each unit. Improper commissioning may result in compressor damage and will void the warranty.
9. Limitation of Liability
To the maximum extent permitted by law, Blue Marine Systems Ltd shall not be liable for indirect or consequential losses including, but not limited to, loss of charter income, loss of vessel use, loss of profit, haul-out expenses or marina costs. Our total liability in connection with any claim shall not exceed the original purchase price of the product. Nothing in these Terms excludes liability for death or personal injury caused by negligence or for fraud.
10. Force Majeure
We shall not be liable for failure or delay in performance resulting from events beyond our reasonable control, including but not limited to war, trade restrictions, embargoes, supply chain disruption, natural disasters, governmental action or transportation delays.
11. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Amendments
We reserve the right to update or amend these Terms & Conditions at any time. The version in force at the time of purchase shall apply to that purchase.
